Oucywo.com respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act (DMCA) and other applicable laws, we have adopted the following policy regarding copyright infringement claims.
Designated DMCA Agent
All DMCA notices must be directed to our designated Copyright Agent. The contact information for our Copyright Agent is as follows:
- Name: Oucywo DMCA Agent
- Email: [email protected]
- Address: Oucywo.com, Legal Department (Electronic notices preferred)
- Website: https://www.oucywo.com
We strongly recommend submitting notices electronically via email to ensure prompt processing. Postal mail submissions will be accepted but may experience delays.
Reporting Copyright Infringement
To report alleged copyright infringement occurring on https://www.oucywo.com, you must submit a written notice containing the following information as required by 17 U.S.C. § 512(c)(3):
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works on a single online site are covered by a single notification, a representative list of such works.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material.
- Information reasonably sufficient to permit us to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Failure to comply with all requirements of this section may result in invalidation of your DMCA notice. Upon receipt of a valid DMCA notice, we will promptly remove or disable access to the allegedly infringing material and notify the user responsible for the content.
Our platform primarily offers AI-powered name generation tools. Names generated through these tools are provided for user convenience and personal or commercial use. However, users must independently verify that any generated names do not infringe existing trademarks or other intellectual property rights. Oucywo.com does not perform trademark searches or guarantee the availability or non-infringing status of generated names. Users assume full responsibility for due diligence.
Takedown Procedure
Once a properly formatted DMCA notice is received, Oucywo.com will:
- Expeditiously remove or disable access to the identified infringing material.
- Notify the user who posted the material of the takedown action and the DMCA notice.
- Take reasonable steps to contact the copyright owner or agent for further instructions if needed.
We maintain logs of all DMCA notifications and actions taken for compliance and auditing purposes. False or misleading claims in a DMCA notice may subject the complaining party to liability for damages, costs, and attorneys’ fees under 17 U.S.C. § 512(f).
Counter-Notification Procedure
If your content has been removed or disabled in response to a DMCA notice and you believe the takedown was a mistake or that the material is not infringing, you may submit a counter-notification. The counter-notification must be a written communication provided to our Designated DMCA Agent containing substantially the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled and the location at which the material previously appeared (e.g., URL).
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
- Your name, address, telephone number, and a valid email address.
- A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or the Southern District of New York if your address is outside the United States), and that you will accept service of process from the person who submitted the DMCA notice or their agent.
Upon receipt of a valid counter-notification, we will promptly notify the original complaining party. If the complaining party does not notify us within 10-14 business days that they have filed a lawsuit against you in court, we will restore the material unless otherwise directed by legal authority.
Counter-notifications must be sent to the same Designated DMCA Agent: [email protected].
Repeat Infringers
Oucywo.com maintains a policy of terminating, in appropriate circumstances, the accounts or access privileges of users who are deemed to be repeat infringers. We monitor DMCA notices and user activity to identify patterns of infringement. Factors considered include the number and severity of prior notices, the user’s response to previous takedowns, and evidence of willful infringement.
Users receive warnings for initial infractions where appropriate. Termination decisions are made at our sole discretion and may occur without prior notice for egregious or repeated violations.
Generated Content and User Responsibilities
The AI name generators on https://www.oucywo.com produce original suggestions based on user inputs and algorithms. These outputs are not derived from scraping or copying copyrighted works without permission. Nonetheless, users are prohibited from using the platform to generate or upload content that infringes third-party copyrights.
Any user-uploaded content, such as custom input prompts or shared generations, remains the responsibility of the user. By using our services, users grant Oucywo.com a limited license to host and display such content solely for the purpose of providing the service. Users represent and warrant that they own or control all rights in their content and that it does not infringe any third-party rights.
As emphasized, while generated names are for user use, independent trademark verification is essential. Oucywo.com disclaims liability for any trademark disputes arising from generated names.
International Users
This DMCA policy applies to all users worldwide, but compliance is primarily governed by U.S. law. Users outside the United States acknowledge that content hosted on our servers is subject to U.S. jurisdiction. We cooperate with international copyright enforcement authorities where feasible.
Abuse of DMCA Process
Submitting fraudulent, bad-faith, or abusive DMCA notices is strictly prohibited. Parties engaging in such conduct may face legal consequences, including monetary damages and injunctions. Oucywo.com reserves the right to report abusive filings to relevant authorities and to pursue all available remedies.
Likewise, users who repeatedly ignore valid DMCA notices risk account suspension or termination, as outlined above.
Changes to This Policy
We may update this DMCA policy from time to time to reflect changes in our practices, legal requirements, or service offerings. Continued use of https://www.oucywo.com following such updates constitutes acceptance of the revised policy. Users will be notified of material changes via email or a site-wide announcement.
